RENTAL AGE AND LICENSE TERM
For Economy class vehicles, you must be at least 18 years old and have a driver's license for at least one year; for Medium and Luxury class vehicles, you must be at least 23 years old and have a driver's license for at least three years; and for VIP class vehicles, you must be at least 28 years old and have a driver's license for at least five years.
CAR RENTAL CONDİTİONS
Since the above conditions will be met during the rental process, you must have your driver's license, Turkish ID card, or passport with you to pick up the vehicle.
PRİCES INCLUDE THE FOLLOWING SERVİCES AND PRODUCTS
* Our vehicles are suitable for physical health, well-maintained by authorized service centers, and are under warranty.
* Airport drop-off and pick-up,
* 24/7 Roadside Assistance,
* Exempt comprehensive insurance,
* Monthly mileage is 5,000 km. Excessive mileage will be billed at a rate of 5 TL + VAT per kilometer.
* Prices include VAT.
ITEMS NOT INCLUDED İN PRİCES
Fuel, traffic fines, highways, bridges, and all types of toll roads, as well as the time spent while the vehicle is detained, are not included in the prices.
Damage to tires, glass, headlights, or taillights is not included in the Exempt Accident Insurance. This insurance can be purchased separately.
GENERAL CONDITIONS
The renter has provided the renter with the car for a pre-determined period, subject to the specified conditions being met. The renter agrees to return the car on the date and time specified in this attached contract, at the same location. The renter may extend the rental period with 24-hour notice and the lessor's approval.
The renter agrees and undertakes not to use the vehicle in the following situations:
a. Transporting any goods whose transport is considered a crime by Turkish law, and other illegal activities,
b. Towing or pushing another vehicle or trailer,
c. In races, speed limits, rallies, trials, motor sports, and speed limit trials,
d. On roads closed to and unsuitable for normal traffic,
e. Carrying passengers exceeding the number of passengers specified by traffic regulations, and in any way carrying non-luggage cargo and explosive, flammable materials,
f. Under the influence of alcohol, drugs, or stimulants,
g. Carrying passengers and goods.
1) The lessor may not allow third parties to use the vehicle without the lessor's approval. In this case, the lessee is obligated to record the identity, address, and driver's license of the third party who will use the vehicle in the contract and to ensure that the person authorized to use the rented vehicle fully complies with all terms of this contract. The persons using the vehicle are jointly and severally liable with the lessee, even if they do not sign the contract.
2) The lessee declares that the residential address specified in this contract is correct and undertakes to immediately notify the lessor in writing of any change to this address. Otherwise, all administrative and legal notices sent to the address specified in the contract will be considered valid, and no objection will be raised regarding service.
3) The lessee is obligated to park the vehicle in a secure, enclosed, and locked location, in compliance with traffic regulations and to ensure safety.
4) If the lessee returns the vehicle to the lessor, they will pay the rent for the period until the official documents related to the vehicle (Traffic Document, Registration Certificate, Insurance, and License Plates) are not returned. They will also be responsible for the cost of obtaining replacements in the event of loss.
5) In the event of the vehicle being confiscated or seized by the authorities due to any incident caused by the lessee, the lessee will be responsible for all costs related to its recovery, as well as the rent for the days spent during this period. If the vehicle cannot be recovered, the vehicle's current market value will be paid by the lessee to the lessor in cash and in one lump sum.
6) Traffic fines and damage incurred during the vehicle's towing are the lessee's responsibility. If the vehicle is detained by traffic, this period is included in the rental period.
7) The lessor: Since the lessor does not manufacture the vehicle, they cannot be held responsible for any accidents, losses, or injuries resulting from mechanical or manufacturing damage to the vehicle or its spare parts.
8) Vehicles may not be taken abroad without the lessor's written consent.
9) The lessee agrees in advance that the personal information specified in the lease agreement will be kept in the lessor's company file and that their name will be included on the warning list (BLACKLIST) in the event of any breach of the agreement, such as on-time payment of the rent or on-time return of the vehicle.
10) The lessee: If any of the specified conditions are not met, the lessor may immediately retrieve the vehicle without a refund, without the need for any legal action or legal action.
11) The renter may terminate the contract at any time, without giving a reason or being obligated to pay compensation, or may refrain from extending it.
12) The customer is responsible for the fuel cost. The renter must fuel the vehicle according to the fuel gauge and return it in the same amount upon return.
13) In the event of justified accidents or if the renter is not available, a replacement vehicle will be provided from a different company, but only for the rental fee of the original vehicle.
14) Vehicle Intervention (accident, malfunction, battery replacement, vehicle change, etc.) is for a maximum of 48 hours.
15) Any additions or changes to these terms are null and void unless agreed upon in writing between the parties.
16) Disputes between the renter and the lessor will be resolved in accordance with Turkish Republic Law in the Izmir Courts and Enforcement Offices.
PAYMENT & DEPOSIT
We leave the payment method to our guests. After meeting our customers at the airport, they can pay by cash or credit card upon vehicle drop-off. In cases of wire transfer, EFT, or mail order, we assist our guests with the return of the vehicle at the airport. For security reasons, we do not process any down payment or credit card charges for our guests before returning the vehicle to the airport.
INSURANCE
Rented vehicles: They are insured against third-party damages under the Highway Traffic Law with Compulsory Liability Insurance, within the legal policy limits. The lessor assumes liability for accidents that cause third-party damages, up to the compensation received from the insurance company, provided that the coverage limits of the Compulsory Liability Insurance taken out for each vehicle are met. Any liability exceeding these limits, as well as any claims for moral damages by the injured parties and their relatives, are the responsibility of the lessee, and the lessor reserves the right to recourse.
The lessee is liable without objection for any damages incurred by the rented vehicle, including transportation and expenses incurred to bring the vehicle to the rental location, and the cost of downtime during the repair period.
However; The renter, who agrees to pay the CDW (Collision Damage Waiver) and TP (Theft Protection) damage exemption premiums, determined and signed at the beginning of the rental period, at the daily rates, is exempt from this liability if they meet the following conditions.
a) If the renter or authorized driver has no disabling conditions as determined by a medical report, they will take the necessary safety precautions at the scene of the accident. They will not interfere with the damaged vehicle in any way, and the names and addresses of the relevant persons and witnesses will be identified. The renter will immediately notify the nearest law enforcement officers of the accident.
b) Since the assessment of liability and blame rests with the competent authorities, they will only describe the nature of the incident and will not admit guilt or responsibility in advance.
c) The lessor must submit to the lessor, within 48 hours at the latest, the Traffic Accident Report obtained from the nearest competent authority (traffic police or gendarmerie), an alcohol report, the other party's car registration, the other party's driver's license and traffic insurance, photographs of the vehicles involved in the accident at the scene, along with the names, addresses, and phone numbers of witnesses. In the event of theft, the lessor must immediately notify the nearest police or gendarmerie station and the lessor. Note: Accident reports must be submitted in full; otherwise, the penalties specified in these articles will be processed.
CASES EXCLUDED FROM INSURANCE COVERAGE
1) Cases where there is no accident or alcohol report,
2) Cases where the accident occurred under the control of a driver whose name is not listed in the contract,
3) Cases where the driver was under the influence of alcohol or drugs at the time of the accident,
4) Cases where the driver does not have a valid driver's license,
5) Cases resulting from violations of traffic rules and excessive speed,
6) All vehicles are equipped with GPS systems. In the event of an accident despite warnings or interventions regarding dangerous driving or exceeding speed limits, the comprehensive insurance policy will not be activated under any circumstances. Furthermore, in such cases, any loss of vehicle value and lost days will be charged to the renter, and no replacement vehicle will be provided.
7) Accidents and damages occurring outside the period specified in the rental agreement.
8) Accidents and damages occurring while towing, pushing, or loading another vehicle or moving or stationary objects. Accidents or damages occurring during the vehicle's arrival, acceleration, rally trials, motor sports, or during use on closed, unsuitable roads as per the normal schedule. Use of the vehicle outside of normal operating conditions (e.g., driving in the wrong direction, driving with high engine temperature, poor road conditions or driving with a flat tire, applying the handbrake, filling with the wrong fuel, etc.).
9) Accidents and damages occurring during the transportation of passengers, non-luggage cargo, and explosive and flammable materials as determined by traffic regulations.
10) Burns and stains on the vehicle's upholstery.
11) The lessor, who is unable to benefit partially or completely from the insurance compensation due to any act or negligence not attributable to the lessor, has the right to recourse against the lessor for any uncollected damages and compensation for the vehicle's termination.
12) Due to circumstances not covered by the coverage, the vehicle will not be replaced, even if the rental period has not ended. If the vehicle is severely damaged (wrecked), the Lessor will be billed at its market value.
13) Careless and careless use of the vehicle (failing to adjust speed according to road conditions in rainy weather, failure to maintain a safe distance from the vehicle in front, and other similar behaviors).
14) Failure to promptly notify the Lessor of an accident or theft, abandoning the vehicle at the scene of the accident (excluding a disabling condition established by a medical report).
15) Failure to return the original keys and registration document in the event of theft.
16) The Lessor is not responsible for theft or loss of valuables in the vehicle.
17) Failure to return the vehicle without prior approval and after the rental period has ended.
18) Financial compensation amounts arising from damage caused to third parties are covered by compulsory liability insurance.
19) The customer is responsible for any amounts exceeding the security deposit.
PİCKUP AND DROP-OFF
Delivery at Izmir Airport is free of charge. Additional fees apply for vehicle delivery or return to other locations.
I have read and understood all the terms and conditions of the Rental Agreement, Customer Information Form, and Damage Assessment Report, all on both front and back pages. I have accepted and confirmed the car rental service with this information, as verbally informed by the vehicle delivery officer. I have received a copy in person.
